User Terms & Conditions

These Terms & Conditions (together with the documents referred to in them) govern your use of our website at  www.scraplocal.co.uk and all related sites, services, applications, and tools, which we operate from time to time (the “Scrap Local Service”).

These Terms & Conditions apply to any person registering as a “User” on the Scrap Local Service, or using the Scrap Local Service as a consumer looking to use our services (a “User”). If you are registering to use the Scrap Local Service as a scrap dealer, or you are using the Scrap Local Service as a scrapyard or scrap collector (a “Scrapyard”) please refer to our Scrapyard & Scrap Collector Terms & Conditions.

By using the Scrap Local Service you confirm that you accept these Terms & Conditions and that you agree to abide by them.

ScrapLocal.co.uk is a trading name of Code Local Ltd – the Scrap Local Service is powered by the marketplace technology developed by Code Local Ltd (“We or “Scrap Local”).

Code Local Ltd is a limited company registered in England and Wales under company number 15070200.

Registering As A User​

In order to benefit from all the features of the Scrap Local Service available to Users you will need to register with us as a User by following the online prompts. You will be asked to provide certain information about yourself including your name, telephone number and email address.

You must ensure that the information provided by you on registration is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively.

By registering as a User you are forming a contract with us. The contract between us will consist of your registration details, these  Terms & Conditions, our Privacy Policy  and our Feedback Policy. Unless we have expressly stated otherwise, in the event of any conflict or inconsistency between these Terms & Conditions and our Privacy Policy or Feedback Policy, or any other document or legal notice published on our Service from time to time, these Terms & Conditions shall take precedence.

Provision of Services To Users​

Following registration, we will make certain services available to you free-of-charge. The services will include the ability to post details of any automotive repair or servicing work you need a Scrapyard or Scrap Collector to do for you (a “Job”), the ability to receive quotes from Scrapyards or Scrap Collectors to Jobs you have posted (“Quotes”) and the ability to post feedback in relation to any Scrapyard or Scrap Collector you have used as a result of your use of the Scrap Local Service (“Feedback”).

You must only post a Job if you have a genuine requirement for the work detailed in the Job to be performed. You must only post Feedback in relation to a Scrapyard or Scrap Collector if you have used them as a result of your use of the Scrap Local Service. In addition, you must ensure that the content of any Job or Feedback you post complies with the provisions of our Acceptable Use Policy set out in Section 8 below.

If you do decide to use the services of a particular Scrapyard or Scrap Collector as a result of your use of the Scrap Local Service, you agree to notify us by updating your Job details accordingly. You can do this by clicking the relevant button on your Job page to “accept” or “confirm” their Quote.

Full details of the services available to Users will be published on www.scraplocal.co.uk from time to time. We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the service without notice.

Our Responsibilities To You​

We will provide the Scrap Local Service to you using reasonable skill and care and in accordance with these Terms & Conditions. However, if you use the Scrap Local Service as a User you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers:

Although we have asked all users to use the Scrap Local Service responsibly, we cannot guarantee the accuracy, integrity or quality of any information you view or receive via the Scrap Local Service, which is provided by, or based on information submitted by, third parties. This includes any information contained in the details of Scrapyards or Scrap Collectors who are listed in our directory (“Listings”) as well as any Quotes you may receive from Scrapyards or Scrap Collectors.

If you use the Scrap Local Service, you acknowledge and agree that we do not endorse or recommend any of the Scrapyards or Scrap Collectors who are listed or who use the Scrap Local Service and we do not check or verify all the information which Scrapyards or Scrap Collectors post on or transmit via the Scrap Local Service. You shall be solely responsible for checking and verifying any information which you access via or receive via the Scrap Local Service before acting on it placing any reliance on it. If you choose to use the services of any particular Scrapyard or Scrap Collector because of information you have received through your use of the Scrap Local Services you do so entirely at your own risk.

If you use the Scrap Local Service, you also acknowledge and agree that information contained in any Quotes for Jobs you have posted are intended to be indicative only and will not form the basis of a binding contract between you and any Scrapyard or Scrap Collector. This is the case even if you “accept” or “confirm” the Quote by clicking the relevant button on the Scrap Local Service. If you choose to instruct a Scrapyard or Scrap Collector to carry out any work for you as a result of your use of the Scrap Local Service, we strongly recommend that you conclude your own written agreement with them clearly detailing the work to be done and the price to be paid. We will not be a party to any agreement or contract which you conclude with a Scrapyard or Scrap Collector as a result of your use of the Scrap Local Service. Further information about how Quotes are formulated and their status is set out in Section 5 below.

PLEASE NOTE: We (Code Local Ltd) will not under any circumstances have any responsibility to you, or liability to you, for the performance or quality of any work which you ask any Scrapyard or Scrap Collector to carry out, or for any acts or omissions on the part of any Scrapyard or Scrap Collector. Scrapyards or Scrap Collectors will at all times remain solely responsible to you for the work they undertake and their own acts and omissions.

 

Status Of Quotes​

When you post a Job on the Scrap Local Service you will receive Quotes from Scrapyards or Scrap Collectors based on the information you have provided, including your vehicle make and model and job type (“Job Criteria”). The Quotes you receive will either be standard Quotes or “SmartQuotes”. All “SmartQuotes” will be clearly identified as such, with the SmartQuote icon.

Standard Quotes are generated where a Scrapyard or Scrap Collector has either prepared a Quote in direct response to your Job, or previously provided a Quote which matches your specific Job Criteria, or has otherwise provided us with information about what they would quote for your specific Job Criteria.

SmartQuotes are generated where we do not hold quoting data for a Scrapyard or Scrap Collector which is an exact match for your Job Criteria. In these cases our SmartQuotes software uses the quoting data we do hold for a Scrapyard or Scrap Collector, as well as algorithms we have developed, to predict what the Scrapyard or Scrap Collector is likely to quote for the Job. PLEASE NOTE: All Quotes (including both standard Quotes and SmartQuotes) provided via the Scrap Local Service are indicative only and are subject to refinement or change by Scrapyards or Scrap Collectors before they commit to undertake any work. Whilst we work closely with Scrapyards or Scrap Collectors and continually seek to improve our systems and processes to ensure that Quotes are as accurate as possible, we cannot guarantee the accuracy of Quote or that at a Scrapyard or Scrap Collector will ultimately be able to able to complete your Job for a Quoted price. We recommend that you seek confirmation of a Quote directly from a Scrapyard or Scrap Collector, before you instruct them to undertake your Job.

We cannot be held responsible for the failure of successful recordings or poor quality phone lines.

Third Party / Ancillary Products & Services​

When you post a Job on the Scrap Local Service you will receive Quotes from Scrapyards or Scrap Collectors based on the information you have provided, including your vehicle make and model and job type (“Job Criteria”). Passwords & Security​

If you register to use Scrap Local Service you will be asked to provide a valid and current email address. You will then receive a password (“ID”) in order to activate and access your account and use Scrap Local Service. You must keep your ID confidential and must not disclose it or share it with anyone else. You are responsible for preventing unauthorised use of your ID.

If you believe there has been a breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms & Conditions, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issue has been resolved.

Acceptable Use Policy​

The Scrap Local Service allows registered users (including both Users and Scrapyards or Scrap Collectors) to create, edit and submit material for inclusion on or transmission via the Service, including (without limitation) by creating Listings, posting Jobs, posting Quotes for Jobs, posting Feedback and sending messages (collectively “User Content”). Whilst we do not seek to monitor or control the submission of User Content, we do reserve the right to delete, move and edit any User Content submitted where (in our absolute discretion) we consider it prudent or necessary to do so.

You agree to comply with all applicable laws and regulations when using the Scrap Local Service. You are solely responsible for all User Content you submit for inclusion on or transmission via the Scrap Local Service. You must ensure that all User Content you transmit via the Scrap Local Service is lawful and honest. In particular you must not post or transmit via the Scrap Local Service any User Content that:

is fraudulent, dishonest or misleading;
is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
encourages conduct that constitutes a criminal offence, gives rise to civil liability or otherwise breaches any applicable laws, regulations or code of practice;
infringes the copyright or other rights of any third party;
is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).

By submitting any User Content to us, or via the Scrap Local Service, you are granting us a royalty-free, non-exclusive licence to use, reproduce, modify, translate, make available and distribute the User Content on or through the Scrap Local Service for the purpose of operating the Scrap Local Service.

The Scrap Local Service allows registered users (including both Users and Scrapyards or Scrap Collectors) to create, edit and submit material for inclusion on or transmission via the Service, including (without limitation) by creating Listings, posting Jobs, posting Quotes for Jobs, posting Feedback and sending messages (collectively “User Content”). General Disclaimers

Whilst we endeavour to ensure that the information available on or through the Scrap Local Service is correct, up to date and accurate we do not warrant the accuracy and completeness of such material. In particular (but without limitation), the Scrap Local Service permits you to access and receive information supplied by third parties, or which is based on information or data supplied by third parties, including third party User Content. The third parties submitting this information are responsible for ensuring that material submitted is accurate and complies with relevant laws and codes. We will not be responsible to you for the conduct of any such third party or for any error or inaccuracy in any material they supply.

Although we aim to offer you the best service possible, we make no promise that the Scrap Local Service will meet your requirements. We cannot guarantee that the Scrap Local Service will be fault or virus free or continuously available. Your access to the Scrap Local Service may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We may change or discontinue the Scrap Local Service, or any part thereof, by giving reasonable notice at any time.

Liability

Scrap Local connects you to Scrapyards and Scrap Collectors and don’t buy from you nor sell to you directly, this is done by third party agents or Scrapyards and Scrap Collectors that use our services to generate new business.

Any monies agreed for items such as scrap metal or scrap cars, collections, removals etc and the sale of used parts or other materials will be supplied or paid you to by the Scrapyard or Scrap Collector themselves, Scrap Local is not responsible for making payments to you or for the quality of the parts or materials you buy.

Payment terms, late payments and payment confirmation should be agreed directly with the agent who claimed the job and who you chose to deal with. 

Any such incident where Scrapyards or Scrap Collectors do not pay for items you sell, the issues should be raised directly with the Scrapyard or Scrap Collector following their complaints procedures.

Scrap Local holds contact details and information for all Scrapyards and Scrap Collectors that use our services and the Scrap Local team will be happy to provide them whenever you use our services. All calls are recorded and stored electronically on our secure servers for up to 3 months should you require copies.

However where recordings aren’t complete, interrupted with network issues or fail to save, Scrap Local can not be held responsible for lost or missing recordings.

To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings or loss of data or for any indirect or consequential losses howsoever arising out of your use of Scrap Local Service or any fault or problem relating to the Scrap Local Service or any content received via the Scrap Local Service.

Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or for fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law.

Your statutory rights as a consumer are not affected by these Terms & Conditions.

Termination Of Services​

We may suspend or cancel your registration and/ or terminate your access to or use of the Scrap Local Service and/ or our agreement with you, if you are in breach of these Terms & Conditions or have made improper use of the Scrap Local Service.

You may cancel your registration at any time by informing us in writing. If you do so you must stop using the Scrap Local Service.

The suspension, cancellation or termination of your registration and your right to use the Scrap Local Services shall not affect either party’s statutory right or liabilities.

Intellectual Property​

Unless otherwise stated, the copyright, database right and other intellectual property rights in the Scrap Local Service (including without limitation all content, data, materials and technology used or appearing in the Scrap Local Service or transmitted through it) belongs to us or our licensors. All rights are reserved.

By using the Scrap Local Service you acknowledge and agree that we collect aggregated and anonymised data concerning usage of the Scrap Local Service and the Jobs and Quotes and Quoting Data submitted to or via the Scrap Local Service. You agree that all intellectual property rights and other rights in such aggregated and anonymised data shall belong to Scrap Local and we may use this data for any purpose whatsoever. However, this data will not include any information from which particular users of the Scrap Local Services (including any Users or Scrapyard or Scrap Collector) can be identified.

Intellectual Property​

Unless otherwise stated, the copyright, database right and other intellectual property rights in the Scrap Local Service (including without limitation all content, data, materials and technology used or appearing in the Scrap Local Service or transmitted through it) belongs to us or our licensors. All rights are reserved.

By using the Scrap Local Service you acknowledge and agree that we collect aggregated and anonymised data concerning usage of the Scrap Local Service and the Jobs and Quotes and Quoting Data submitted to or via the Scrap Local Service. You agree that all intellectual property rights and other rights in such aggregated and anonymised data shall belong to Scrap Local and we may use this data for any purpose whatsoever. However, this data will not include any information from which particular users of the Scrap Local Services (including any Users or Scrapyard or Scrap Collector) can be identified.

Privacy & Cookies​

The scraplocal.co.uk website and the Scrap Local Service includes areas where you are requested to, or can, input information about yourself. Any information you submit to us shall be subject to the terms of our Privacy Policy.

We use cookies on our website and as part of the Scrap Local  Service. Further information about cookies and how we use them can be found in our Cookies Policy. By registering use you are consenting to our use of cookies in the ways described in our Privacy Policy and Cookies Policy.

General

All notices shall be given to us via email or by post using the contact details set out in Part 1 above, or to you at either the email or postal address you provide during registration. Notice will be deemed to be given when an email is received (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 2 working days after the date of posting.

If any provision of these Terms & Conditions is held by any court of competent authority to be void or unenforceable in whole or in part, the other provisions of these Terms & Conditions and the remainder of the affected provisions shall continue to be valid.

The failure to exercise a right or remedy provided by these Terms & Conditions or by the law does not constitute a waiver of other rights or remedies.

We may revise these Terms & Conditions at any time. You are expected to check these Terms & Conditions from time to time to take notice of any changes we make as they are legally binding on you. Some of the provisions contained in these Terms & Conditions may also be superseded by provisions or notices published elsewhere on our website or the Scrap Local Service.

These Terms & Conditions will be subject to the laws of England and Wales and the English courts shall have jurisdiction to resolve any disputes between us.

2. Registering As A Scrapyard Or Scrap Collector

In order to benefit from all the features of the Scrap Local Service available to Scrapyards or Scrap Collectors you will need to register with us as a Scrapyard or Scrap Collector by following the online prompts. You will be asked to provide certain information about your business including your business name and contact details.

In addition you will need to provide photo ID, proof of address, insurance documents and any other documentation such as licenses or information that we may consider necessary from time to time, as part of the registration process.

You must ensure that the information provided by you on registration is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you provide, by updating your details, in order that we may communicate with you effectively.

By registering as a Scrapyard or Scrap Collector you are forming a contract with us. The contract between us will consist of your registration details, these Terms & Conditions, our Privacy Policy, our Code of Conduct and our Feedback Policy. Unless we have expressly stated otherwise, in the event of any conflict or inconsistency between these Terms & Conditions and our Privacy Policy or Code of Conduct or Feedback Policy, or any other document or legal notice published on the Scrap Local Service from time to time, these Terms & Conditions shall take precedence.

3. Provision of The Services To Scrapyards Or Scrap Collectors

Following registration, we will make certain services available to you. The services will include the ability to include details of your business in our directory (“Listings”), the ability to view or receive details of jobs which have been posted by Users (“Jobs”) and the ability to submit quotes in response to Jobs (“Quotes”), including using our SmartQuote technology and other methods.

 

Please note that Listings must not contain any contact details for your business, although you will have the ability to communicate with Users using the Scrap Local Services’ online messaging systems and you may also be given the opportunity to contact Users where you have submitted a Quote in response to a Job they have posted. 

You must also ensure that any information you post to or transmit via the Scrap Local Service, including any content contained in Listings and any Quotes and messages, complies with the provisions of our Acceptable Use Policy set out Section 12 below.

 

Full details of the services available to Scrapyards or Scrap Collectors via the Scrap Local  Service will be published on our website from time to time. We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the Scrap Local Service without notice.

4. Your Responsibilities

You agree to abide by these Terms and Conditions when using the Scrap Local Service and in your dealings with Users.

You also agree to abide by the Scrap Local Code of Conduct at all times when using the Scrap Local Service and in your dealings with any Users.

You agree that we shall be entitled to permanently or temporarily suspend your access to and use of the Scrap Local Service and/ or terminate our agreement with you, in the event that we have reason to believe that you may have failed to comply with our Terms & Conditions or Code of Conduct, or you are alleged to have done so, or we otherwise believe (in our reasonable discretion) that you have acted in a way which is or could be detrimental the Scrap Local Service or its reputation. Under these circumstances we shall not be obliged to give you a refund of any Membership Fees, Subscription Fees or Success Fees you have paid.

You agree that you will only use any information concerning any User and any Jobs they have posted, which we provide to you or which you obtain via the Scrap Local Service, for the purpose of submitting Quotes and (if you are selected to undertake the work) for the purposes of discussing that work with the User and undertaking the Work. You agree that you will not use such information for any other purpose without first obtaining the User’s prior consent. You also agree to keep any such information secure and to comply with all applicable laws concerning privacy and data protection in relation to your use of that information.

You shall be solely responsible for checking and verifying the details of any Job which is transmitted to you via the Scrap Local Service before you agree to undertake any work for a User and for agreeing with the User the terms on which any work will be performed.

You shall be solely responsible for complying with all applicable laws and regulations in your dealings with Users and for the performance and quality of any work which you agree to undertake for any User.

You agree that you must only use the Scrap Local Service in connection with your own business and must not (without our prior written consent) use the Scrap Local Service for the benefit of any other business providing scrap metal services, waste electronic services, vehicle recycling services or the breaking and dismantling of vehicles for parts or any other services tied to the scrap metal industry.

PLEASE NOTE: By registering as a Scrapyard or Scrap Collector and by using the Services you are agreeing that you shall be solely responsible for all products, services, monies and work you may undertake or perform for any User or supply to any User and for your dealings with any User. You agree to indemnify us and hold us harmless from any costs, losses or claims which you/we may suffer or incur and which result from any information you submit or transmit via the Scrap Local Service or from any work which you may agree to perform for any User or from your dealings with any User or your use of their information.

5. Our Responsibilities To You

We will provide Scrap Local Service to you using reasonable skill and care and in accordance with these Terms & Conditions. However, if you use the Scrap Local Service as a Scrapyard or Scrap Collector you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers:

You acknowledge and agree that we will enable Scrapyards or Scrap Collectors to post Quotes in response to a selection of Jobs based on criteria which we (in our absolute discretion) may determine from time to time. 

The criteria may include your geographical location as well as the quantity or quality of Quoting Data we hold for you amongst other criteria. In addition you acknowledge that the number of Quotes which may be transmitted to a User in relation to any particular Job may be limited to Quotes from a specified number of Scrapyards or Scrap Collectors. 

Accordingly, we do not provide any guarantee that registering as a Scrapyard or Scrap Collector will result in you being able to submit Quotes, or in Quotes being submitted on your behalf, in relation to any Jobs, or in relation to any particular volume of Jobs, even if you have purchased membership. Nor can we guarantee that your use of the Scrap Local Service will result in you winning any work or any particular volumes of work.

You acknowledge and agree that we do not check or verify the details of any Jobs which are posted. We have asked all users to use the Scrap Local Service responsibly and to provide accurate information, but cannot guarantee the accuracy, integrity or quality of any Jobs or other material which is posted by third parties (including Users).

By registering as a Scrapyard or Scrap Collector you also understand and agree that Users who have used your services will be able to provide Feedback and we may give you a rating based on the Feedback you have received. Whilst we have asked all users of the Services to act responsibly, we do not actively monitor, check or verify Feedback which is posted. 

Accordingly, you acknowledge and agree that we (Scrap Local) shall not have any responsibility to you or liability to you for any Feedback which is posted by any User and we will not usually become involved or intervene in complaints or disputes concerning Feedback, although we reserve the right to do so in exceptional circumstances. You may, if you feel that Feedback is misleading or libellous, contact us and we will investigate but we shall not be obligated to take any action. Please refer to our Feedback Policy for further information concerning our approach to Feedback.

6. Membership Fees

In order to have your Listing published in the Scrap Local Service and in order to submit Quotes for Jobs, Scrapyards or Scrap Collectors must become a member by paying the applicable annual or monthly membership fees (the “Membership Fees”). 

Information about our Membership Fees will be posted on the Scrap Local service page from time to time.

Please note that payments made for Membership Fees are non-refundable irrespective of the number of Jobs which are notified to you and irrespective of whether or not you have submitted Quotes for Jobs or the number of Quotes which are submitted.

Importantly, please be aware that as our membership services are solely for business-to-business use, the usual consumer protection provisions, including any ‘cooling-off periods’, do not apply. 

Once you have committed to a membership plan, the contract is considered binding and enforceable. 

This means that no right to cancel or receive a refund will exist once the membership fee has been paid, except as otherwise provided in these terms and conditions. 

This reflects standard practice in the business-to-business sphere and we encourage you to carefully consider your requirements before committing to a membership.

By becoming a member on an annual plan, you agree that your membership will continue for a year and renew automatically every year thereafter (each a “Membership Year”) and that the annual Membership Fee will be automatically charged to you, unless you have notified us at least thirty (30) days before the renewal date that you do not wish to wish to renew your membership for another Membership Year. 

You will receive an email fourteen (14) days and seven (7) days prior to renewal informing you that this is about to happen. 

You can cancel your subscription at any point prior to the renewal date by calling us on 01706 577 574.

If you signed up to a monthly subscription on a 30 day rolling contract, then you must provide thirty (30) days notice for cancelling such service.  

7. Wallet Top-ups

To place bids or claim leads you must have sufficient funds in your Scrap Local wallet via the app or console to cover the cost of your fees if successful in winning the job quoted for. Your wallet is accessible on desktop / mobile devices.

Wallet top-ups are made via our secure payment gateway stripe.

Wallet top-ups are non-refundable and non-transferable to other accounts and are valid for twelve (12) months after purchase

 

8. Approved Leads Cost Per Lead / Cost Per Enquiry

By becoming a member and by submitting Quotes or by allowing for Quotes to be submitted on your behalf, in respect of Jobs, you are also entering into a legally binding contract with us under which you agree to pay the applicable enquiry/lead fee (the “Lead Fee”).

Scrap Local provides your Scrapyard or Scrap Collection business with leads for you and/or your team to quote on and do business with Users, not the guarantee of sale. You are paying for the chance of business not for guaranteed result of business.

9. Bidding For Work

When enquiries are submitted into our system, they’re available for premium members to claim for 20 minutes before converting into leads for bids.

Hot Leads for bids are the same as hot leads, they’ve never been spoken to by Scrap Local and may not respond to our offer.

Pre-Qualified Leads for bids have been spoken to, may have images and additional information.

When a lead converts to bids, you will be able to place your bids on the lead. You must only place bids to buy, not to view or inspect and our success fee will be £25 or 10% of your highest bid (whichever is greatest).

It’s free to place bids, however you must have sufficient funds in your wallet to cover our success fees if we are successful in winning the job for you. This is to prevent agents bidding on work with no intention of collecting the job.  

Our success fee will be charged as soon as the user accepts your price and the lead will be added to your lead feed for you to claim & contact. 

We advise contacting the customer as soon as possible to confirm collection date/time and all communications must be made via the system to protect all parties.

Failure to respond to won leads within 24h of assignment will result in fees being charged in full and non refundable.

 

Unless Scrap Local is in possession of an item up for bids, we act as the agent for the Seller, providing a venue for participation in a Virtual Sale under these Terms and Conditions. In such cases, our liability is limited as described in these Terms and Conditions.

A bid is binding if accepted by a notice displayed on the Website. 

Upon notification of a successful bid, a Contract of Sale is concluded. A contract of sale is concluded when the Seller accepts the bid. In all cases, the Contract of Sale is between the winning bidder and the Seller. These Terms and Conditions govern the Contract of Sale.

We serve as the sole arbitrators for all disputes and matters related to pre-sale, auction, or post-sale issues. Our decisions are final, and no reason may be given.

We may refuse to accept any bid or regulate the bidding process at our discretion. We may remove, restrict, or withdraw any Lot from sale at any time before a Contract of Sale is concluded.

We may also cancel a concluded Contract of Sale at our discretion. If we cancel a Contract of Sale, neither party may rely on it for any purpose, but the buyer may receive a refund for any deposit or part of the purchase price already paid at our discretion.

You agree to indemnify and hold us harmless from any liability arising from our decisions related to disputes, Lot withdrawals, bid refusals, and cancellation of concluded Contracts of Sale.

We reserve the right to withhold any Lot before, during, or after a sale for any reason.

You will not obtain any rights or title to a Lot until full payment is received. You will still be legally obligated to purchase the Lot, but we and/or the Seller are not required to transfer any rights or title until full payment is made, subject to our right to cancel a concluded Contract of Sale and these Terms and Conditions.

You assume full responsibility for any purchased Lot upon the conclusion of a Contract of Sale, at which point all risks are transferred to you. 

You agree to indemnify and hold us harmless against any losses or damages arising from damage to any Lot you have agreed to purchase.

Where a lot is a vehicle, whilst Scrap Local does carry out due diligence checks by means of HPI checks (currently using TotalCarCheck.co.uk) it if your sole responsibility as the buyer to conduct your own checks.

9.1 Bidding For / Claiming Jobs – Fees, Penalties & charges

“Placing A Bid” SALES

We may offer some Lots for purchase outside our usual auction through your use of our “Make An Offer” facility. These Terms and Conditions shall apply (as permitted by law) to all Make An Offer sales, with the provisions of this clause 14 taking precedence over any conflicting provisions elsewhere in these Terms and Conditions.

When you use our Make An Offer facility to place a bid on a Lot, that offer represents your offer to purchase the relevant Lot at the price you state, not to inspect or view the relevant Lot. Your offer is only accepted when we send e-mail confirmation to you that we have accepted your offer (the “Offer Acceptance E-mail”). Acceptance will be complete at the time we send the Offer Acceptance E-mail to you.

We will not be held responsible if, for any reason outside our reasonable control, either your offer and/or the Offer Acceptance E-mail does not reach its intended destination or is delayed.

YOU ARE BUYING LOTS IN YOUR CAPACITY AS A TRADE MEMBER, SO CONSUMER PROTECTION LAWS DO NOT APPLY TO MAKE AN OFFER PURCHASES AND ALL IMPLIED TERMS (STATUTORY OR OTHERWISE) ARE EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. ALL MAKE AN OFFER SALES ARE FINAL – RETURNS ARE NOT ACCEPTED – AND ARE MADE ON AN “AS IS, WHERE IS” BASIS. IT IS YOUR SOLE RESPONSIBILITY TO MAKE ALL NECESSARY ENQUIRIES AND INSPECTIONS TO SATISFY YOURSELF AS TO A LOT’S STATUS, CONDITION AND HISTORY BEFORE USING OUR MAKE AN OFFER FACILITY. THE PROVISIONS OF CLAUSE 8 APPLY IN FULL TO MAKE AN OFFER PURCHASES.

All offers you make using our Make An Offer facility are exclusive of VAT (at the applicable prevailing rate) and our Fees. Payment terms for Make An Offer purchases are the same as for auction purchases and are set out in clause 10.3.

We may at our discretion cancel any offer you make using our Make An Offer facility, either before or after acceptance. If we cancel your Make An Offer order after you have made payment in respect of that order, we will refund the sums you have already paid.

 

Fees, Payments, and Deliveries

As a vehicle auction client, you should be aware that the fees related to buyer’s premium, membership, convenience, storage, lot retrieval, late payment, relisting, delivery, guest, or other charges can vary by location and are subject to change without notice. These fees are displayed on our website. It is your responsibility to determine the applicable fees for each facility and purchase.

Upon the completion of a sale, you are obligated to pay the purchase price for the lot you have bought, along with any applicable VAT and other related fees. You may not ask a third party to pay any amounts owed to us on your behalf. We have the right to refuse payment from anyone other than you.

We must receive the full payment, including the price and all fees, within two business days of the sale’s conclusion. Acceptable payment methods include bank transfer, banker’s draft, cash (up to a maximum of £8,000), and debit or credit card (subject to a 3% handling charge plus VAT). Cash payments are not accepted for Category B vehicles or their associated fees and charges.

If payment is not received within the specified time frame, we may cancel the sale and/or relist the lot at our discretion. You will be responsible for any relisting fees. If you cause an excessive number of lots to be relisted, your membership may be suspended or revoked.

Upon receiving full payment, the right and title to the lot will transfer to you. However, this is subject to our right to cancel any sale and negate the title transfer in accordance with our terms and conditions.

If you choose and pay for delivery, we will arrange delivery to your specified address without further request. While we will exercise reasonable care during delivery, you acknowledge that many lots are damaged and may incur additional damage during loading, unloading, or transit. We are not liable for any further damage to the lots during these processes.

Alternatively, you may choose to collect the lot after the sale, provided that we have received full payment for it. You agree to comply with our safety procedures and site rules when collecting lots and to hold us harmless for any loss or injury resulting from your failure to do so.

You agree not to use any purchased vehicle on public roads if it is in an unroadworthy condition, cannot be used lawfully, or lacks required legal certificates. You also accept responsibility for registering each vehicle with the DVLA or completing a statutory off-road notification. Any penalties, fees, or charges related to the vehicle are your responsibility from the date of sale.

Our liability for each purchased lot ends upon the transfer of the right and title to you. Any lot remaining uncollected on our premises is at your risk, and we are not responsible for any loss or damage to such lots. Additionally, you may be charged storage fees for lots remaining uncollected after the date of sale.

We reserve the right to sell any lot purchased by you, as your agent, if it remains uncollected or if you owe us storage fees or other outstanding amounts. We may deduct and retain any costs incurred, as well as our sales costs, from the sale proceeds, remitting any remaining balance to you.

When making payments to us, they must originate from a bank account or credit/debit card registered in the same name as your account with us. If payments are found to have been made from a different account or card, we reserve the right to suspend or close your account immediately.

9.2 Bidding For / Claiming Jobs – SmartBids

SmartBids are placed on your behalf when you provide your price per ton to Scrap Local.

Your price per ton will be used to place bids on local enquiries (within 10 miles radius of your location) and we will place bids for work on your behalf.

When adding your price per ton, you are committing to bids being placed on End of Life vehicles of scrap metal to win work on your behalf.

You must regularly update your price per ton to stay competitive and prevent work being won on your behalf at the wrong price.

9.3 Bidding For / Claiming Jobs – Submission of Quotes & Quoting Data

By registering to use the Scrap Local Service, you agree that we may automatically submit Quotes on your behalf in response to Jobs which are posted in your area. 

Quotes will be formulated based on information provided by the User including vehicle make and model and job type (“Job Criteria”) as well as quoting data we hold for you (“Quoting Data”). 

Standard Quotes will be generated where you manually submit a Quote in direct response to a Job, or may be automatically submitted on your behalf where you have either previously provided a Quote which matches the Job Criteria, or you have otherwise provided us with information about what you would quote for the Job Criteria.

Automated Quotes may be automatically generated and submitted on your behalf where we do not hold Quoting Data for you which is an exact match for the Job Criteria. In these cases our Automated Quote software uses the Quoting Data we do hold for you, as well as benchmarking algorithms we have developed, to predict what you are likely to quote for the Job.

PLEASE NOTE: If you use the Scrap Local Service, you understand, acknowledge and agree that any Quotes we submit on your behalf will be significantly influenced by the Quoting Data we hold for you. 

In general, the more up to date Quoting Data we hold for you the more accurate the Quotes we submit on your behalf are likely to be. We therefore strongly encourage Scrapyards or Scrap Collectors to provide as much Quoting Data as possible and to regularly review the Quoting Data we hold to ensure that it is accurate and up to date.

PLEASE ALSO NOTE: Whilst we are continually working to improve our SmartQuote technology and believe that the Automated Quotes it generates should (in most cases) provide a good indication of what a particular Scrapyard or Scrap Collector is likely to quote for a particular Job, within acceptable accuracy tolerances, we do not represent, warrant or guarantee to that Automated Quotes will be an accurate in all cases. 

Given the complexity involved in quoting for scrap metal, used auto parts and scrap and salvage vehicle prices, no system can be perfect and errors and inaccuracies will inevitably occur. 

You should take care to carefully review all Automated Quotes which have been submitted on your behalf and update or amend them (either using the Scrap Local Service or in discussions with Users) if you do not consider that they are accurate. Under no circumstances will we have any liability to you, for any losses or other matters, arising from inaccuracy or other error in any SmartQuote.

You can submit, review and update the Quoting Data we hold for you by visiting Scrapyards or Scrap Collectors Automated Quotes, searching for the service type and then selecting the quote and updating the price. 

Where you are asked to bid on a lead – After a Job has been accepted with your highest bid, you cannot update the Quote for that specific Job within the Scrap Local Service. 

However, you can discuss any changes directly with the User and edit the price for future Quotes of a similar nature. If the User rejects an offer after an Automated Quote is given and the quote is deemed to be a reasonable offering for your yard to pay, you will still be liable for the fees.

You can choose to submit Quotes for specific types of Jobs by amending the categories for which you have Job alerts selected.

You must ensure that all Quoting Data you provide to us is (at the time of submission) accurate and not misleading.

We make it clear to all Users that all Quotes are indicative only and only become binding on Scrapyards or Scrap Collectors once the User has confirmed it directly with you in person. 

However, you should be aware that if you significantly change or depart from Quotes given, without good reason, this may adversely impact on a User’s experience and impact on the Feedback and ratings they provide. 

It also affects the service levels we wish to attain as a company going forward. 

We operate on a 3 strike rule against chipping customers on price and your account may be suspended if inaccurate quotes are frequently given and deliberately adjusted just to outbid competitors and reduced / increased on collection / delivery. 

Quotes given to customers should be clear, transparent and guaranteed. We therefore, encourage you to provide us with comprehensive and up to date Quoting Data to ensure that your Quotes are as accurate as possible.

9.4 Bidding For / Claiming Jobs – Hot Leads

Hot leads are fresh enquiries that have been submitted to Scrap Local via a lead form on scraplocal.co.uk or one of our partner sites.

Hot leads are available to claim for the first 20minutes of submission and are sold on a cost per lead basis not a cost per acquisition basis and are sold on a non-refundable cost per lead basis. Hot leads are not a guarantee of work, they are a work opportunity. 

Hot leads have never been contacted by Scrap Local and are sold once, on a first come first served basis (we don’t double sell leads) but they are the same leads the Scrap Local team claims & contacts to send won or pre-qualified leads to agents.

Whilst we try to continually improve the quality of our leads with validation and blacklisting, contact-ability cannot be 100% guaranteed.

If you are unable to contact a customer because the call went to voicemail or rang out, changing the job status to “unable to contact” triggers our system to send push notifications, SMS & Emails to customers to prompt a call back.

Status changes will even create follow-up sequences to remind agents to contact the customer again in a few hours.

Where the contact number is uncontactable three (3) times, system statuses have been updated and automations have been triggered, our team will attempt to contact the lead, verify the invalid data & add invalid numbers to a blacklist to ensure no future enquiries are submitted into our lead forms with the same number as it won’t pass validation.

Charges do still apply but may be reviewed at our discretion.

9.5 Bidding For / Claiming Jobs – Pre-Qualified Leads Cost Per Lead

Where Scrap Local has attempted to close a lead on your behalf and is unsuccessful, we gather as much information from the customer about the lead as possible to pre-qualify the lead and send out to our local agents to choose if they would like to claim a pre-qualified lead and quote a higher price to the customer.

These are vetted leads that come directly to Scrap Local head office and we have attempted to close, but unsuccessful – the contact information is confirmed and correct and the user is happy to be contacted. 

Pre-qualified leads are not guaranteed conversions and are sold on a non-refundable cost per lead basis.

Placing bids on Pre-Qualified leads is not a guarantee of purchase, you will be notified if you have been outbid and notified of any changes on the lead.

By becoming a member and by submitting Quotes or by allowing for Quotes to be submitted on your behalf, in respect of Jobs, you are also entering into a legally binding contract with us under which you agree to pay the applicable enquiry/lead fee (the “Success Fee”) to Scrap Local. 

In addition to the agreed price which you must pay to the User directly by their preferred payment method within Forty Eight (48) hours of collection date.

In the event that your Quote is accepted by the User, or you are otherwise engaged by the User to undertake the Job, you will be liable to pay the success fee to us, Scrap Local along with the price quoted to the User (which you must pay directly to the User). 

Full details of the applicable Success Fee for a particular jobs will be published on the Scrap Local CRM system on the pre-lead before you accept and claim a job.

You agree to notify us promptly (and in any event within 2 (2) working days) if you are selected, or engaged, by a User to undertake any Job in respect a Quote has been submitted, by updating your account details accordingly.

Success fees may vary from time to time and will be provided to you whenever a Job is notified to you. By claiming or accepting jobs, you accept the charges and fees. If jobs aren’t collected due to you missing appointments or not sticking to an agreed schedule or pricing, you will still be liable for the fees.

9.6 Bidding For / Claiming Jobs – Won Leads – Cost Per Acquisition

In addition to the hot leads which is a cost per lead service selected by the majority members sign up to, we do offer a cost per acquisition service to all members who qualify to receive them. 

Won leads will clearly state the commission/cost per lead on these enquiries in the pre-lead before you claim.

These are vetted leads that come directly to Scrap Local head office and are closed, confirmed bookings or collections priced at your price per ton or based on your bid in the auction.

By becoming a member and by submitting Quotes or by allowing for Quotes to be submitted on your behalf, in respect of Jobs, you are also entering into a legally binding contract with us under which you agree to pay the applicable enquiry/lead fee (the “Success Fee”) to Scrap Local. 

In addition to the agreed price which you must pay to the User directly by their preferred payment method within Forty Eight (48) hours but no later than five (5) working days maximum of collection date.

In the event that your Quote is accepted by the User, or you are otherwise engaged by the User to undertake the Job, you will be liable to pay the success fee to us, Scrap Local along with the price quoted to the User (which you must pay directly to the User). 

In the event we win an enquiry on your behalf, your account will be billed instantly and you fail to contact the customer within 24h of us winning, your account will be charged a £25 Success fee.

Full details of the applicable Success Fee for a particular jobs will be published on the Scrap Local CRM system on the pre-lead before you accept and claim a job.

You agree to notify us promptly (and in any event within 2 (2) working days) if you are selected, or engaged, by a User to undertake any Job in respect a Quote has been submitted, by updating your account details accordingly.

Success fees may vary from time to time and will be provided to you whenever a Job is notified to you. By claiming or accepting jobs, you accept the charges and fees.

If jobs aren’t collected due to you missing appointments or not sticking to an agreed schedule or pricing, you will still be liable for the fees.

9.7. Lead Quality & Data Validation

Whilst we try to be proactive in consistently improving lead quality, enquiries made via our website may not be 100% contactable.

We have applied several layers validation to our lead forms including but not limited to, phone carrier checks, blacklisted phone number checks, invalid dial tone checks, SMS failure checks. Postcode validation, email validation & Vehicle registration number validation using external 3rd party API tools.

We check submitted phone numbers for the correct number of digits and cross reference these with mobile carrier data to validate authenticity, rarely do invalid numbers pass validation but in the rare occasions they do we cross reference with IP data to ensure authenticity.

IP Addresses are submitted with form submissions in addition to the IP addresses of logged in users for accounts of Agents, Drivers and Customer accounts. 

Any lead fraud, foul play or abuse of our lead forms that are tracked back to customer accounts will result in accounts being blocked and IP addresses being blacklisted.

Should any lead fraud, foul play or abuse of our lead forms be traced back to the IP address or agent accounts, this will result in agent accounts being closed along with any balances in your Scrap Local wallet being non refundable. 

Any fraudulent leads claimed by another agent that results in renumeration to agent accounts will be distributed from your available funds and should these charges exceed your remaining wallet balance, you authorise Scrap Local to charge you any success fees in full, in addition to £5 penalty per lead fraudulently submitted on our lead forms. 

We respect all of our agents and won’t tolerate abuse of our lead forms of any kind to cause financial impact to competitors. 

To get system valuations you are able to create leads from within your app or console and have no need to generate quotes from our customer facing lead forms and we reserve the right to close your account should you submit enquiries on customer facing lead forms without prejudice.

9.8. Contact With Previous Owners

If you are purchasing a lot directly from Scrap Local, unless we have given you written confirmation that the previous owner of a Lot is the Seller and have provided you with written authorisation to contact such Seller, you agree that you shall not contact the previous owner of a Lot.

You agree that due to the nature of the Lots that we sell, it is not always possible for us to remove personal effects and personal data entirely and agree that any personal effects and/or personal data that you may discover will be securely disposed of.

We reserve the right, in our discretion to terminate or suspend your registration and/or access to the Website or Services should we be advised that you have contacted a previous owner contrary to the provisions of clause outlined in this document.

10. Payment Terms

Unless otherwise stated, all fees are quoted in Pounds Sterling. 

You are responsible for paying all fees together with any applicable VAT by such method as we may reasonably require from time to time. 

Unless we have agreed in writing to invoice you for any fees due under this agreement (or agreed in writing to collect payment by some other method) we require that all fees be paid via credit or debit card or other payment method registered with us and you authorise us to collect all such payments immediately on the date that they become due. 

Where we have agreed to invoice you for any fees you agree pay all such invoices on the date of invoice or within seven (7) days of the date of our invoice – no later.

In the event that we are unable to collect of any fees via Direct Debit OR from your designated credit or debit card or other payment method, or (where applicable) you have failed to pay any invoice submitted by us by the due date for payment.

Then (in addition to any other rights and remedies which may be available to us) you agree that we may charge a late payment administration fee of £5 per lead or £25.00 per invoice whichever is greater (the “Late Payment Administration Fee”) together with interest on the overdue amount (from the due date up to the date of actual payment) at the rate of 4% per annum above the base rate for the time being of the Bank of England. Such interest shall accrue on a daily basis and be compounded quarterly. 

In these circumstances, we also reserve the rights to suspend your access to or use of the Scrap Local Service until any outstanding sums are paid in full and/ or to terminate our agreement with you in accordance with Section 15 below.

Scrap Local reserves the right to enforce debt collection agencies to act on our behalf and take legal action to recover funds not paid and in cases that involve invalid refund claims.

10. 1. Payments To User / Customer

It is your responsibility as the collection agent to make payment in full to the User / customer for their scrap metal, scrap or salvage vehicle or end of life vehicle unless otherwise stated by Scrap Local.

Scrap Local informs customers that our payment terms are made daily between 5-7pm and are paid into their designated account no later than the following business day between 5-7pm. 

Failure to make payment to the customer within this period will result in suspension of your account.

Failure to make payment to the customer within five (5) working days will result in suspension of your account and Scrap Local will attempt to recover full payment plus administration fee of £25 or 3% whichever is greater from your wallet balance or designated bank account.

If funds are unavailable from your wallet or designated bank account due to insufficient funds, Scrap local reserves the right to pass your details on to local law enforcement to recover any funds for the customer.

10.2. Customer Cancellations

When you claim hot or pre-qualified leads, you are fully responsible for communicating with the customer and Scrap Local takes no responsibility for cancellations, no-shows, wasted trips or any other financial liability that may be incurred from purchasing the leads.

We strongly recommend that you contact the customer when you claim the leads and also before you set off to collect and ensure the user is available at the collection location at the date/time mutually agreed between you. We recommend you do this via our app / console at every point of communication.

If you claim a won lead – that has been won on your behalf by the Scrap Local team, from a SmartBid (using your price per ton) or a standard bid, then you must comply with the following rules to be eligible for a refund to your wallet.

If personal contact details are exchanged or customer details are exposed at any stage of the process, then your rights to dispute leads will be waived without prejudice and no refunds (in part or in full) will be given.

You must only communicate with customers via the system by phone, SMS or Email at all times to protect all parties from any disputes / discrepancies.

Your driver must provide photo evidence and upload directly into the Scrap Local app or console at the collection location.

You must have made successful calls to the customer via the portal prior to setting off to collect and had verbal confirmation by phone or incoming SMS with confirmation. If you turn up without getting confirmation prior to setting off we will not be liable for any refunds.

Customers are instructed to notify us 24 hours prior to collection date/time. 

When a customer calls Scrap Local or sends an SMS, if you own the lead, inbound calls will be connected to the primary contact on your account.

If a customer sends an inbound SMS or message and you own the lead, all users on your account will be notified by push notification & Email for you to respond adequately.

Scrap Local takes no responsibility or financial liability for wasted trips, haulage fees, subcontractor fees, staff wages, wait times, parking charge notices, clean air zone fees or any other penalties incurred at any stage of the lead purchasing process.

If you subcontract your collection/haulage, please ensure you have communicated clearly with the customer via the system and remember any personal details exchanged will waive your right to dispute leads with Scrap Local.

If the adequate processes have been followed, Scrap Local will attempt to contact the customer on your behalf during work hours 8.30am – 4.30pm.

Administration fees of £25 may still be charged (at our discretion), but fees exceeding this £25 administration charge may be refunded to your wallet solely at our discretion and providing personal contact information is not disclosed by either party (user, driver, customer, agent, voicemail message, SMS or Email.) 

11. Liability

To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings or loss of data or for any indirect or consequential losses howsoever arising out of your use of Scrap Local Service or any fault or problem relating to the Scrap Local Service or any content received via the Scrap Local Service.

You are liable for carrying out your due diligence on all enquiries for things including but not limited to HPi checks, proof of ownership, waste licenses and other due diligence surrounding the source of materials any user may enquire about through our forms, over the phone.

Whilst communications via our platform are recorded and securely stored for your protection and the protection of users making an enquiry, we cannot be responsible for any missed, deleted or incomplete records against jobs.

If we are found to have any liability to you under or in connection with these Terms & Conditions or in relation to the Scrap Local Services more generally, whether under contract, tort (including negligence) breach of statutory duty or otherwise, our total aggregate liability to you shall not, in respect of any and all liabilities arising in any Membership Year, exceed an amount equal to the total Membership Fee and Success Fees paid by you to us in that Membership Year.

Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or for fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law.

To the extent permitted by law, you, any authorized bidder, and your guests unconditionally and irrevocably waive and release any rights to seek recovery from us, our directors, officers, employees, representatives, agents, subsidiaries, partners, affiliates, or suppliers for any damages, losses, liabilities, costs, expenses, or claims arising from or related to property damage or any other event occurring at our premises or on our website.

As permitted by law, you agree to indemnify, defend, and hold us harmless from any damages, losses, liabilities, costs, expenses, or claims made by you, any authorized bidder, or your guests arising from or related to property damage or any other event occurring at our premises or on our website.

You further agree to indemnify, defend, and hold us harmless from any liability for taxation, duty, charge, or levy, including penalties, charges, costs, and interest related to them, that we may incur as a direct or indirect result of your use of our website and/or services.

Under no circumstances shall we be liable for any special, incidental, or consequential damages or loss of profits resulting from or related to the sale, distribution, use, or inability to use any lot, or your or any authorized bidder’s use or inability to use our services, even if we had been previously or subsequently advised of the possibility of such damages or losses. As a trade member, you agree that the provisions of this clause are fair and reasonable.

We do not guarantee or warrant that any lot we sell can be legally registered in any jurisdiction, and you accept all risks associated with any variations in title or registration laws that may adversely affect the marketability or roadworthiness of lots you purchase.

We are not responsible or liable for any losses you sustain arising from defects, errors, or omissions in paperwork issued by any government department, executive agency, or other competent authority.

It is your sole responsibility to comply with all environmental laws, import/export procedures, inspections, fees, emissions requirements, or other applicable regulations related to your purchase and the collection and transportation of such purchase from our premises. You agree to indemnify, defend, and hold us harmless from any losses we may suffer as a result of your non-compliance.

Whilst we do from time to time conduct vehicle background checks and may from time to time provide HPI checks as part of our due diligence, it is your responsibility to conduct your own due diligence, HPI / vehicle background checks in addition to any credit checks via credit reference agencies as Scrap Local will not be held responsible for any losses or penalties incurred.

12. Refunds Or Discounts

In the event that you fail to notify us that within five (5) working days that you were selected or engaged to undertake a Job and we are informed that you were, or if we have reasonable grounds for believing that you were, you agree that you will be liable to pay the Success Fee to us together with an additional administration charge of £5.99 (the “Non-Disclosure Administration Fee”) per lead.

You agree that Cost Per Lead Fees & Success Fees (and, where applicable the Non-Disclosure Administration Fees) are payable if you are selected or engaged to undertake a Job, irrespective of whether the Job is ultimately completed or is cancelled.

We shall be under no obligation to refund such fees in respect of any Jobs which are not completed or cancelled and refunds will only be given in our absolute discretion. Under no circumstances will requests for refunds be considered where:

  • They are made later than seven (7) days after we have successfully collected a Success Fee, or invoiced you for a Success Fee, or made our first attempt to collect the Success Fee from your designated credit or debit card or other payment method; or
  • Personal contact information is exchanged verbally by phone, SMS or via recorded voicemail message from user or agent voicemail services; or
  • Agent has turned up for job without contacting User or customer in advance; or
  • They are made in respect of Jobs where we hold insufficient evidence that follow-up actions have been taken to manage the booking with the User, which must include attempts to contact the User by telephone on the designated contact number and through the Scrap Local Services’ messaging system, on or after the date that the booking was confirmed within the system and within a reasonable time of any contact from the User; or
  • They are made at levels that we consider to be excessive based on general usage of the Scrap Local Service, even if the above criteria have been satisfied.
 

Only when contact is made with the User via phone, email or any other form of electronic communication provided to you by the Electronic Scrap Local CRM System will you be eligible for disputing enquiries.

We are a cost per lead service, not a cost per acquisition service and Scrap Local does not waive any fees for loss of business due to losing deals on price, response time, distance from job or any other reason for loss if the User was genuine and the deal wasn’t closed.

Pay Per Click, Display Ads, Video Ads and other biddable media services and advertising services often charge a cost per click (CPC) or cost per impression (CPI), Such as Google, Facebook Ads, Bing Ads, whereas Scrap Local operates as a cost per lead service.

Scrap local provides information of the lead before claiming the lead so you can decide whether or not you wish to claim or reject it. You aren’t obligated to claim. You can see the date & time the lead was submitted to Scrap Local, the postcode prefix area the lead is located and the type of enquiry it is with information of the said enquiry (such as vehicle make and model if an End of Life Vehicle). You are under no obligation to purchase the lead at this stage but by clicking “CLAIM” and confirming you wish to claim the lead, you accept the terms, liability and the charges associated with that lead.

If you claim the lead but fail to even attempt to contact the User, you will be charged full price for the lead irrespective of the lead being contactable or not. This lead could have been claimed by another approved member.

15. End-of-Life Vehicles

Disclaimers

All lots we offer for sale are sold on an “as is, where is” basis, which means that they are sold without any express or implied warranties, including, but not limited to, warranties of fitness for a particular purpose or satisfactory quality. We explicitly disclaim the accuracy and completeness of any information provided to you regarding lots, whether in written, verbal, or digital image form (“Lot Information”). Lot Information is merely for your convenience, and you agree not to rely on it when deciding whether or how much to bid on any lot.

Lot Information may include, without limitation, details such as year, make, model, condition, damage amount, damage type, roadworthiness, driveability, accessories, mileage, odometer readings, vehicle identification numbers, title, required repairs, repair costs, repair history, title history, service history, and total loss history. We expressly disclaim any representations (written or verbal), warranties, and guarantees concerning the lots we offer for sale.

We do not guarantee the availability of keys for any vehicles sold through us, even if keys are visible in online images or present during a pre-purchase inspection. The lots we offer for sale may be missing components or parts. We do not guarantee that vehicles comply with or can be modified to meet local emission or safety requirements or that they are able to or allowed to be repaired.

In the case of electric or hybrid electric vehicles, we make no representations or warranties regarding the inclusion of batteries (or the right to use the batteries) within the sale. You may not acquire ownership or the right to use the relevant battery packs, and you should verify this before bidding.

It is your sole responsibility to ascertain, confirm, research, inspect, and/or investigate, to your satisfaction, the lots we offer for sale and any and all Lot Information before deciding whether and how much you wish to bid on any lot.

HPI / Vehicle Background Checks

Whilst we do from time to time conduct vehicle background checks and may from time to time provide HPI checks as part of our due diligence, it is your responsibility to conduct your own due diligence, HPI / vehicle background checks in addition to any credit checks via credit reference agencies as Scrap Local will not be held responsible for any losses or penalties incurred.

DVLA Fines, Fixed Penalty Charge Notices, Speeding Fines, Parking Fines.

Failure to issue Certificates of Destruction or notify the DVLA end of life vehicles have been scrapped may result in penalties should any fines incurred after the date of sale.

Should Scrap Local become involved in any administration to resolve any parking fines, speeding fines, penalties of any kind when your business has purchased the vehicle – Scrap Local will deduct a £50 administration fee from your wallet balance for dealing with any enquiries from Users / Customers.

Users are informed that it is their responsibility to notify the DVLA, however being an approved or partner on Scrap Local you have a responsibility to take care of the paperwork for the customer.

15. 1. End-of-Life Vehicles Cat B (Breaker Only)

Ireland Category B Purchasers

If you reside in the Republic of Ireland and seek to purchase Category B vehicles for purposes other than export, you must fulfill specific criteria and supply us with relevant documentation (as outlined on our Website). We may also request evidence that you meet the criteria and have the required documentation at any time, and you agree to provide this immediately upon our request. We reserve the right to revoke your ability to purchase Category B vehicles if you fail to provide such evidence when requested.

Prior to releasing a Category B vehicle to you, and at any time thereafter upon our request, you must provide us with all necessary details and documentation related to your purchase. This information enables us to fulfil our legal duty of care under environmental legislation and comply with any other applicable obligations or requirements. If you or a third party intend to transport a Category B vehicle away from our premises, you must provide a valid Waste Collection Permit for the transportation.

Category B vehicles are sold on the condition that all usable parts will be removed and the vehicle’s body shell/frame/chassis will be crushed or destroyed. You must issue an electronic Certificate of Destruction (or a valid equivalent) for each Category B vehicle purchased from us within 30 days of its departure from our premises. You will also provide us with a copy of each Certificate of Destruction (or valid equivalent) upon demand.

If you fail to provide the Certificate of Destruction (or valid equivalent) on demand and within 30 days of a Category B vehicle leaving our premises, we reserve the right to suspend your account and/or impose a lifetime ban on you from our services. We also reserve the right to apply an administration fee of €35 to your account for the additional administration involved in handling your account. Furthermore, we reserve the right to cancel the Contract of Sale and repossess the Category B vehicle to ensure it is not used on public highways in violation of these Terms and Conditions.

You must grant us reasonable access to your premises (or any other location where a purchased Category B vehicle is stored) during regular business hours to audit the disposal process and verify compliance with these Terms and Conditions. At the time of such audit, you shall provide us with evidence that you meet the criteria and have the required documentation, as well as any Certificates of Destruction (or valid equivalents) that we request for any Category B vehicles you have purchased through us.

Overseas Category B Purchasers

If you do not reside in the Republic of Ireland and wish to purchase Category B vehicles, you must provide us with various documents (as detailed on our Website) before we permit you to bid on Category B vehicles in our auctions. We may also request evidence of these documents at any time, and you agree to provide them immediately upon our request. We reserve the right to revoke your ability to purchase Category B vehicles if you fail to provide such evidence when requested.

As with Ireland Category B purchasers, you must provide us with all necessary details and documentation related to your purchase of a Category B vehicle prior to its release and at any time thereafter upon our request. This information enables us to fulfil our legal duty of care under environmental legislation and comply with any other applicable obligations or requirements. If you or a third party intend to transport a Category B vehicle away from our premises, you must provide a valid Waste Collection Permit for the transportation.

It is your sole responsibility to ensure that each country through which you transport a vehicle (and/or in which you dock during transportation) and the receiving country will allow the entry or docking (as applicable) of the Category B vehicle you are transporting, and that you fully comply with all local laws governing the vehicle.

Category B vehicles are sold on the condition that all usable parts will be removed and the vehicle’s body shell/frame/chassis will be crushed.

To place bids on, or purchase cat B End of Life Vehicle’s, you must hold a valid ATF license and be authorised to issue Certificates of destruction.

16. Partner Programmes

From time to time we may work with third parties to make certain opportunities to undertake automotive recycling or scrap metal recycling work available to our membership of Scrapyards or Scrap Collectors and/ or to enable our membership of Scrapyards or Scrap Collectors to access discounted products or services or offers or benefits provided by or in partnership with third parties (“Partner Programmes”).

If you participate in any Partner Programmes, you understand, acknowledge and agree that, in addition to continuing to comply with these Terms and Conditions and our Code of Conduct, you must also comply with any applicable Partner Programme Terms & Conditions or Service Level Agreements.

 

17. Acceptable Use Policy

The Scrap Local Service allows users (including Scrapyards or Scrap Collectors and Users) to create, edit and submit material for inclusion on or transmission via the Scrap Local Services, including (without limitation) by creating Listings, posting Jobs, submitting Quotes for Jobs, posting Feedback and sending messages (“User Content”). Whilst we do not seek to monitor or control the submission of User Content, we do reserve the right to delete, move and edit any User Content submitted where (in our absolute discretion) we consider it prudent or necessary to do so.

You agree to comply with all applicable laws and regulations when using the Scrap Local Service. You are solely responsible for all User Content you submit for inclusion on or transmission via the Scrap Local Service. You must ensure that all User Content you transmit via the Scrap Local Service is lawful and honest.

In particular you must not post or transmit via the Scrap Local Service any User Content that:

  • is fraudulent, dishonest or misleading;
  • is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
  • encourages conduct that constitutes a criminal offence, gives rise to civil liability or otherwise breaches any applicable laws, regulations or code of practice;
  • infringes the copyright or other rights of any third party;
  • is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).

By submitting User Content to us you are granting us a royalty-free, non-exclusive licence to use, reproduce, modify, translate, make available and distribute the User Content on or through the Scrap Local Service and partner sites and trading companies of Scrap Local for the purpose of operating the Scrap Local Service.

18. General Disclaimers

Whilst we endeavour to ensure that the information available on or through the Scrap Local Service is correct, up to date and accurate we do not warrant the accuracy and completeness of such material. In particular (but without limitation), the Scrap Local Service permits you to access and receive information supplied by third parties. The third parties submitting this information are responsible for ensuring that material submitted is accurate and complies with relevant laws and codes. We will not be responsible to you for the conduct of any such third party or for any error or inaccuracy in any material they supply.

Although we aim to offer you the best service possible, we make no promise that the Scrap Local Service will meet your requirements. We cannot guarantee that the Scrap Local Service will be fault or virus free or continuously available. Your access to the Scrap Local Service may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We may change or discontinue the Scrap Local Service, or any part thereof by giving reasonable notice at any time.

18.1. Passwords & Security

If you register to use the Scrap Local Service you will be asked to provide a valid and current email address. 

You will then be asked to choose a secure password (“ID”) in order to activate and access your account and use Scrap Local Service. You must keep your ID confidential and must not disclose it or share it with anyone outside your business or organisation. You are responsible for preventing unauthorised use of your ID.

If you believe there has been a breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms and Conditions, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issue has been resolved.

Upon utilizing our auction platform, you are granted access to the features and methods necessary for submitting bids on the items available for auction.

We shall endeavor to provide you with reasonable and practical assistance in accessing the platform. However, we cannot be held liable if you are unable to access it for any reason. We do not guarantee uninterrupted, secure, error-free access to the platform, nor that it will operate as stated in these Terms of Service. Consequently, we reserve the right to suspend or discontinue the platform and/or services without incurring any liability to you.

Provided that you comply with these Terms of Service and any incorporated documents, we will facilitate your access to the platform and services as outlined herein. Nevertheless, we reserve the right, at our discretion, to terminate or suspend your registration and/or access to the platform or services for any reason, including but not limited to non-compliance with clause 11.

Throughout your registration as a Trade Member and your utilization of the platform and services, you will furnish us with data. We shall protect the privacy of such data in accordance with our Privacy Policy, which you accept by continuing to use the platform or services. You are responsible for ensuring the accuracy and currency of your data and for promptly submitting any updates. We shall only disclose your data to third parties as stipulated in our Privacy Policy, these Terms of Service, or with your prior consent.

By accessing and using the platform or services, you commit to acting in a lawful, diligent, and honest manner, and to comply with all applicable laws and regulations. You warrant that all information provided during registration or at any subsequent time is and shall remain accurate and truthful.

You agree not to undermine, jeopardize, disrupt, or harm the platform or services, nor to intercept, misappropriate, reuse, misappropriate, or re-utilize any system, data, images, or information provided through the platform or services.

You acknowledge sole responsibility for any actions taken using your username and password to access the platform or services, whether performed by you, third parties, or with or without your consent or knowledge.

You may designate one individual (an “Authorized Bidder”) to submit bids on your behalf, provided you notify us in advance and supply their name and contact information. Upon our acceptance of the Authorized Bidder, you may share your username and password with them. Neither you nor your Authorized Bidder shall permit or encourage any other party to place bids. You accept sole responsibility for the actions of your Authorized Bidder.

Except in cases where we approve an Authorized Bidder, you agree to maintain the confidentiality of your username and password, and not to disclose or share them with any other party.

In the event that you believe the confidentiality of your username and/or password has been compromised, you must promptly notify us. We shall make reasonable efforts to supply you with alternative login credentials, while reserving the right to restrict or terminate your access to the platform and services at our discretion, in accordance with these Terms of Service.

18.2. Intellectual Property

Unless otherwise stated, the copyright, database right and other intellectual property rights in the Scrap Local Service (including without limitation all content, data, materials and technology used or appearing in the Scrap Local Service or transmitted through it) belongs to us or our licensors. All rights are reserved.

By using the Scrap Local Service you acknowledge and agree that we collect aggregated and anonymised data concerning usage of the Scrap Local Service and the Jobs and Quotes and Quoting Data submitted to or via the Scrap Local Service. You agree that all intellectual property rights and other rights in such aggregated and anonymised data shall belong to Scrap Local and we may use this data for any purpose whatsoever. However, this data will not include any information from which particular users of the Scrap Local Services (including any Users or Scrapyard or Scrap Collector) can be identified.

18.3. Privacy & Cookies

The scraplocal.co.uk website and Scrap Local Service includes areas where you are requested to input information about yourself. Any information you submit to us shall be subject to the terms of our Privacy Policy.

We use cookies on our website and as part of the Scrap Local Service. Further information about cookies and how we use them can be found in our Cookie Policy. By registering use you are consenting to our use of cookies in the ways described in our Privacy Policy and Cookie Policy.

General

All notices shall be given to us in writing via email or by post using the contact details set out in Part 1 above, or to you at either the email or postal address you provide during registration. Notice will be deemed to be given when an email is received (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 2 working days after the date of posting.

If any provision of these Terms & Conditions is held by any court of competent authority to be void or unenforceable in whole or in part, the other provisions of these Terms & Conditions and the remainder of the affected provisions shall continue to be valid.

The failure to exercise a right or remedy provided by these Terms & Conditions or by the law does not constitute a waiver of other rights or remedies.

We may revise these Terms & Conditions at any time. You are expected to check these Terms & Conditions from time to time to take notice of any changes we make as they are legally binding on you. Some of the provisions contained in these Terms & Conditions may also be superseded by provisions or notices published elsewhere on our website or the Scrap Local Service from time to time.

These Terms & Conditions will be subject to the laws of England and Wales and the English courts shall have jurisdiction to resolve any disputes between us.

3. Payment and Fees

  • Winning Bidders: If you are the highest bidder, payment must be completed within 24 hours of the auction closing. Failure to pay within this timeframe may result in the cancellation of your bid and suspension of your account.
  • Payment Methods: We accept payment via [insert payment options, e.g., bank transfer, credit card]. No vehicle will be released until full payment has been received and cleared.
  • Auction Fees: Buyers may be charged a buyer’s premium or other fees associated with the auction. These will be clearly stated on the auction listing page.
  • Deposit/Pre-Authorisation: Some auctions may require a deposit or pre-authorisation to participate. If applicable, this will be stated in the auction details.

4. Vehicle Condition and Descriptions

  • Sales “As Seen”: All vehicles sold through the Platform are sold “as-is” and “as seen,” without any warranties or guarantees regarding condition, suitability, or fitness for a particular purpose. Buyers are encouraged to carefully review all available information prior to bidding.
  • Vehicle Descriptions: While we strive to provide accurate descriptions and images, we cannot guarantee the completeness or accuracy of this information, including the vehicle’s mechanical condition, mileage, or damage. Buyers assume all risk regarding the vehicle’s condition.
  • No Warranty on Vehicle History: We are unable to provide guarantees about a vehicle’s history, including prior damage or repairs. Buyers should consider this when bidding.

5. Buyer’s Responsibilities

  • Inspection of Vehicles: We do not offer physical viewings of vehicles. Buyers are responsible for reviewing all available listing information. By placing a bid, you accept the vehicle in its current condition.
  • Collection and Transport:
    • Vehicles must be collected from our location at Goose House Lane, Darwen, Lancashire, within 24 hours of auction closing.
    • Buyers are responsible for arranging transportation, and vehicles must be collected using appropriate means such as a truck or trailer. Driving vehicles away from the premises is not permitted.
    • Any costs associated with the collection or transport of the vehicle are the buyer’s responsibility.
  • Transfer of Ownership: Salvage Local will facilitate the transfer of ownership once payment is received. The buyer must comply with all legal requirements for the transfer of vehicle ownership.

6. Cancellation and Refunds

  • No Cancellations: Once a bid is placed, it cannot be cancelled or withdrawn. If you are the winning bidder, you are legally obligated to complete the purchase.
  • No Refunds: All sales are final. Refunds will not be issued for any reason, including dissatisfaction with the vehicle’s condition, failure to inspect the vehicle details, or delays in transportation.

7. Disputes and Liability

  • Dispute Resolution: Any disputes arising from the use of the Platform or the purchase of a vehicle should be resolved through direct communication between the buyer and seller.   • Account Suspension: We reserve the right to suspend or terminate accounts at our discretion. This includes cases of non-payment, fraudulent activity, or misuse of the Platform.
  • Fair Use: Users are expected to participate in auctions in good faith and not engage in practices such as bid manipulation or shill bidding.
